Dennis was retained to manage our HOA's finances and file our tax returns. He miserably failed at these simple tasks by repeatedly "losing" checks and failing to deposit many of those he did receive in a timely manner. He neglected to provide any kind of timely reporting of accounts. He could not provide simple account statements to our members or track HOA dues. But most egregiously, he failed to file proper tax forms which resulted in our organization losing our tax exempt status and incurring fines and penalties. He lied about filing the returns and after this was discovered (and when asked) his response was "I didn't know which forms to file". He is unreliable and incompetent. We have filed complaints with both the IRS and FTB. In addition, we are looking into filing with the California Accountancy Board as he purports to be an accountant but is not. Here was his response when I informed him that he had not filed the correct forms for our annual taxes. Does this sound like the voice of someone you would want to have handling your sensitive financial affairs?; "Back in 2011, I had done some research and pretty much determined that the forms 990N and 199N could be filed instead of a full tax return since the HOA's income was less than $50,000. Maybe that was incorrect, but that is what I thought at the time. I believe those 2011 and 2012 were filed in those years. After that, they were not filed timely which created this problem. I would like to correct the problem since it occurred while I was working for you. The returns that you said you have are the only ones that I filed. We may have to check with the IRS re 2011 and 2012." Note that he begged me to remove this review and offered me $1,000 to do so. I refused. I am reposting it in the hope of informing others. Here's the note from Dennis: "I know that our time together was difficult, but to help make up for these penalties and any inconvenience, I would l like to send a check for $1000 to the HOA if you will agree to remove your Yelp review and agree not to file any complaints. Once I see that the Yelp review has been removed and I receive confirmation that complaints will not be filed, I will mail out a check."
